New Delhi : The Supreme Court on Tuesday said the National Investigation Agency(NIA) cannot question the legitimacy of Hadiya’s choice.
“A major woman can’t be forced to live with her parents. Only Hadiya has a right to decide her choices,” the bench said.
The apex court was hearing a plea submitted by Hadiya’s husband Shafin Jahan against the Kerala High Court annulling their marriage.
“Can a court annul a marriage when both the man and the woman are adults ? “ asked the court which had previously criticised the HC.
Raghunath, one of the counsels for Hadiya’s father Ashokan said, “We expect NIA to file a report and permit the girl to continue her studies. We are happy that she is safe,” adding, “Let us see what happens”.
The SC will hear further arguments on Feb 22.
Hadiya’s father Ashokan had petitioned the court that his daughter was being trapped by a racket that’s linked to terror and sought to annul her marriage with Shafin, an allegation denied by Hadiya who said she chose the marriage from her own free will.
NIA endorses the claim that there exists a machinery that engages in converting girls of other religion to Islam as part terror proliferation.
