CJI Will Decide Allocation of Cases and Constitution of Benches : SC

A bench comprising Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud dismissed a Public Interest Litigation (PIL) ruling that “ the Chief Justice of India is the first among equals and has the authority to decide allocation of cases and setting up of benches”.

Last week, senior advocated and former law minister Shanti Bhushan had filed PIL in the Supreme Court for Clarification on the administrative authority of the Chief Justice of India as the “master of the roster” and seeking to lay down procedures and procedures to be adhered to in preparing the roster for allocation of cases to benches.

Bhushan had insisted that the matter should not be dealt by a bench that comprises Dipak Misra.
