Change Of Heart : Centre Approves Justice KM Joseph’s Elevation

The Centre today cleared elevation of Uttarakhand High Court Chief Justice KM Joseph as Supreme Court Judge after its previous objection to Supreme Court recommendation of  the same.

The govt had stalled Justice Joseph’s elevation citing abundant representation from Kerala as against inadequate judges in the top court from other states.

The stand led to a face-off with SC collegium reiterating its choice of Justice Joseph for a second time last month just before one of its members Justice Jasti Chelameshwar retired.

Tchnically, an appointment cannot be revoked by the centre if Supreme Court collegium repeats a name the second time.

The law ministry today said “Objections to Justice Joseph’s elevation were not personal but procedural.”.

Meanwhile the ministry has started the process of appointing Justice Joseph as top court judge along with Madras high Court Chief Justice Indira Banerjee and Orissa High Court Chief Justice Vineer Saran.
